Terms of Service

These Terms apply to every visitor, registered user, and organisation that accesses Zaptrom, whether on a Free, Pro, or Team plan. Continuing to use the service after any update to these Terms means you accept the updated version.

If you are accepting these Terms on behalf of a company or other organisation, you confirm that you have the authority to bind that organisation, and the word you in these Terms refers to that organisation as well as to you personally where relevant.

Zaptrom is operated by Heřman Tajovský, Hornomlýnska 1136/8, Czech Republic (in these Terms, Zaptrom, we, us, or our). You can reach us at support@zaptrom.com.

Service

the Zaptrom web application, including account features, projects, connected mailboxes, imported and generated lead data, AI Lead Finder, and related functionality.

Account

the registered profile you or your organisation use to access the service.

Content

any data, text, files, lists, or other material you import, create, or generate using the service, including AI generated drafts.

Connected mailbox

a Gmail, Microsoft or Outlook, or SMTP email account that you authorise Zaptrom to send outreach messages through.

Discovery Credit

the unit that AI Lead Finder consumes, where one credit equals one complete AI Lead Finder search.

Zaptrom is a business tool. It is not directed at children, and it is not intended for use by anyone under 16 years of age. By using the service you confirm that you meet this age requirement and that you have the legal capacity to enter into these Terms.

You are responsible for ensuring that your use of Zaptrom, and any outreach you send through it, complies with the laws that apply to you and to the people you contact.

You can create an account with an email address and password, or by signing in with Google. Account authentication is handled by our backend platform, and password hashes are held by that platform, so Zaptrom staff never see your plaintext password. You may optionally add a profile name.

You are responsible for keeping your account credentials confidential and for all activity that happens under your account. Tell us promptly at support@zaptrom.com if you believe your account has been accessed without authorisation.

Zaptrom maintains an internal admin mode used only by the operator for support, security, and platform maintenance purposes.

Zaptrom helps you organise cold email outreach in projects. You can import or manually add contacts, generate leads with AI Lead Finder, connect your own email accounts to send outreach, track message activity, and collaborate with invited team members who hold editor or viewer roles.

Work is organised into projects, each with an owner and invited members. Access to project data is restricted at the database level to the owner and accepted members, enforced on our servers.

Support is available through an in-app AI assistant and by email. Support conversations are stored so we can follow up on and resolve your requests.

Zaptrom offers three plans: Free, Pro, and Team. Pro and Team plans can be billed monthly or annually.

• Free: 0 USD, includes 1 Discovery Credit.
• Pro: 12 USD per month, includes 30 Discovery Credits per month.
• Team: 39 USD per month, includes unlimited Discovery Credits.

One Discovery Credit equals one complete AI Lead Finder search. Your monthly credit allowance resets at the start of each calendar month, and unused monthly credits do not roll over to the next month.

You can separately purchase credit packs of 25, 50, or 100 Discovery Credits. Purchased pack credits do not expire, and they are only used after your monthly allowance for the current month has been fully spent.

If an AI Lead Finder search fails to complete, the credit spent on that search is refunded automatically. You do not need to contact support for this.

Paid plans are billed in advance on a recurring basis, either monthly or annually depending on the option you choose. Annual billing commits you to the annual price for the plan and billing period you selected, charged upfront for the full year.

All payments and card data are handled entirely by our payment processor, Stripe. Zaptrom never receives or stores your card number. We store limited billing information, such as your subscription status, plan, current billing period end date, and Stripe customer and subscription identifiers, so we can manage your account.

Prices shown may be subject to applicable taxes, which will be calculated and added by Stripe where required by law.

If a payment fails or your card is declined, Stripe may automatically retry the charge. If payment is not successfully collected after retries, we may suspend your paid access and move your account to the Free plan.

You can cancel a paid subscription at any time. When you cancel, your paid access continues until the end of the period you already paid for. At the end of that period, your account automatically returns to the Free plan rather than being deleted.

Cancelling does not entitle you to a refund for the remainder of an already started billing period, except as described in the section below on refunds and withdrawal rights.

Payments already made for a started billing period are generally non-refundable, except where the law requires a refund or where Zaptrom decides, at its own discretion, to make an exception.

If you are a consumer in the European Union, the law may give you a statutory withdrawal right of 14 days when you enter into a distance contract. Please note that by starting a paid subscription, you ask for the service to begin immediately, which can affect how a withdrawal right applies. Where the law gives you a withdrawal right, please contact us at support@zaptrom.com and we will handle your request in line with applicable law.

If you believe you were charged in error, or you have a question about a specific charge, the fastest way to resolve it is to email support@zaptrom.com with your account email and the date of the charge.

If your account moves to a plan with lower limits, whether by cancellation, non-payment, or your own choice, your existing data is never deleted or locked as a result. Projects, contacts, messages, and connected accounts you already have remain intact and accessible.

Going over a plan limit only affects your ability to create new projects beyond what your current plan allows. It does not remove or restrict anything you already created.

You agree to use Zaptrom only for lawful business outreach purposes, and in a way that respects the rights of the people you contact and the integrity of our systems.

You are responsible for all Content you import, create, or send through the service, and for making sure your use of the service, including your outreach, complies with these Terms and with applicable law.

Without limiting the section above, you must not use Zaptrom to do any of the following:

• Send spam, unsolicited bulk messages, or messages that violate applicable anti-spam or e-privacy law.
• Harass, threaten, defraud, or deceive any person or organisation.
• Send content that is unlawful, defamatory, discriminatory, obscene, or infringes the rights of others.
• Impersonate any person or organisation, or misrepresent your affiliation with a person or organisation.
• Scrape, harvest, or collect data in a manner that violates a third party's terms of service or applicable law.
• Attempt to gain unauthorised access to Zaptrom's systems, other users' accounts, or connected mailboxes that are not your own.
• Reverse engineer, decompile, or attempt to extract the source code of the service, except where the law expressly permits it.
• Resell, sublicense, or provide the service to third parties as your own product without our written permission.
• Upload malicious code, or use the service to distribute malware or conduct phishing.
• Interfere with or disrupt the service, its servers, or its networks, including through excessive automated requests.
• Use the service to build, train, or benchmark a competing product.
• Violate any applicable law, including data protection, consumer protection, or telecommunications law.

We may investigate suspected violations and take action as described in the section on suspension and termination.

Zaptrom gives you tools to organise and send outreach, but you remain fully responsible for how you use them. This includes:

• The recipient lists you import, create, or generate, and where they came from.
• Having a lawful basis to contact each recipient, including any consent or legitimate interest assessment that applicable law requires.
• The content of the messages you send, including their accuracy and appropriateness.
• Honouring unsubscribe requests promptly and not contacting people who have opted out.
• Complying with all applicable law governing electronic communications and marketing, including the GDPR, the ePrivacy rules applicable in the EU and EEA, the US CAN-SPAM Act, and equivalent rules in other jurisdictions where you send outreach.

Zaptrom acts as a processor of the recipient and lead data that you decide to collect and use for your outreach, and you act as the controller of that data, responsible for the decisions about what to collect, why, and how.

Outreach messages are sent through your own connected mailbox, whether Gmail, Microsoft or Outlook, or an SMTP account you configure. Zaptrom's own transactional email to you, such as welcome messages, sign-up confirmations, password resets, invitations, and billing notices, is sent separately by Zaptrom, not through your connected mailbox.

By connecting a mailbox, you agree to comply with the terms of service, acceptable use policies, and sending limits of that provider, whether Google, Microsoft, or your SMTP host. Zaptrom is not a party to your agreement with that provider.

If your email provider suspends, throttles, or otherwise restricts your account, we may be unable to send outreach on your behalf until that restriction is resolved. Zaptrom is not responsible for actions taken by your email provider.

You can disconnect a connected mailbox at any time in Settings, and you may connect more than one account.

You can import contacts and company data by uploading a CSV, TXT, XLSX, or XLS file, by adding entries manually, or by generating them through AI Lead Finder.

By importing or entering data into Zaptrom, you warrant that you have the right to use that data for the purposes you use it for, that you have a lawful basis to hold and use it, and that your use of it, including any outreach based on it, complies with applicable law and with these Terms.

You are solely responsible for the accuracy, legality, and source of any data you import or generate.

Zaptrom includes AI powered features, including AI generated message drafts, research summaries, scores, and confidence indicators, which are stored against the relevant company or lead record.

AI generated content may be inaccurate, outdated, or unsuitable for your purpose. You must review any AI generated draft or research summary before sending it or relying on it. Zaptrom does not guarantee the accuracy, completeness, or suitability of AI generated content.

AI Lead Finder is currently offered as a beta feature. It uses third-party services to discover and verify publicly available business information and to enrich, score, and draft messages for discovered leads. Search queries, discovered candidates, confidence data, and sources are stored so that runs can be resumed and reviewed.

As a beta feature, AI Lead Finder may change, be interrupted, or produce inconsistent results. No accuracy of discovered leads or business results from using AI Lead Finder is promised.

You keep ownership of the Content you import into Zaptrom and of the AI generated drafts created for your account. Zaptrom keeps ownership of the Zaptrom software, brand, and interface, and nothing in these Terms transfers that ownership to you.

By using the service, you grant Zaptrom a limited licence to host, store, process, and transmit your Content solely as needed to provide, maintain, and support the service for you.

You must not copy, modify, or create derivative works of the Zaptrom software or brand elements, except as these Terms expressly allow.

If you send us feedback, suggestions, or ideas about Zaptrom, you agree that we may use them to improve the service without any obligation or payment to you.

Zaptrom relies on third-party services to operate, including Stripe for payments, our backend platform for authentication and storage, Resend for transactional email from Zaptrom, and, for AI Lead Finder, Perplexity, Firecrawl, and Google Gemini models accessed through an AI gateway.

These providers have their own terms and may operate independently of Zaptrom. We are not responsible for the availability, accuracy, or performance of third-party services outside our control.

We work to keep Zaptrom available and reliable, but we do not promise that the service will be uninterrupted, error free, or available at any particular time. The service may be unavailable from time to time for maintenance, updates, or reasons outside our control.

We may change, add to, or remove features of the service over time. Where a change materially reduces functionality you rely on, we will make reasonable efforts to let you know in advance.

You may stop using Zaptrom and close your account at any time by contacting support@zaptrom.com.

We may suspend or terminate your access to the service, in whole or in part, if we reasonably believe you have violated these Terms, including using the service for spam, harassment, deception, scraping abuse, or illegal activity, or if required to do so by law.

Where practical, we will give you notice before suspending or terminating your account, but in cases of serious or urgent risk we may act without prior notice.

You can delete companies, projects, and connected accounts yourself at any time while your account is active. If you want your account deleted entirely, contact us at support@zaptrom.com, and we will remove your account and its project data from our live systems without undue delay.

Some records may be kept for longer where necessary for accounting, security, or to establish, exercise, or defend a legal claim.

The service is provided on an as is and as available basis. To the maximum extent permitted by law, Zaptrom disclaims all warranties, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

We do not promise any particular level of uptime, that outreach messages will be delivered or opened, that AI generated content or AI Lead Finder results will be accurate, or that using the service will produce any particular sales or business results.

Nothing in this section limits any right you have as a consumer that cannot be excluded under the law of your country of residence.

To the maximum extent permitted by law, Zaptrom will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the service.

To the maximum extent permitted by law, Zaptrom's total liability arising out of or related to these Terms or the service will not exceed the amount you paid to Zaptrom for the service in the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

You agree to indemnify and hold Zaptrom harmless from any claims, losses, liabilities, and expenses, including reasonable legal fees, arising from your use of the service, your Content, your outreach, or your violation of these Terms or applicable law.

Zaptrom will not be liable for any delay or failure to perform caused by events outside our reasonable control, including outages of third-party providers, internet or infrastructure failures, natural disasters, war, or governmental action.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, or by operation of law.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect, and the unenforceable provision will be interpreted to reflect the parties' original intent as closely as possible.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Zaptrom regarding the service, and supersede any prior agreements on the same subject.

We may update these Terms from time to time, for example to reflect changes to the service or to applicable law. We will update the last updated date at the top of this page, and where changes are significant we will make reasonable efforts to notify you, such as by email or an in-app notice.

Your continued use of Zaptrom after an update takes effect means you accept the updated Terms.

These Terms are governed by the laws of the Czech Republic, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or the service will be subject to the exclusive jurisdiction of the courts of the Czech Republic.

If you are a consumer, you keep the benefit of any mandatory consumer protection rights available to you under the law of your country of residence, and nothing in this section takes those rights away.
